Question:

K1 Visa Questions?

I have a few questions regarding the K1 visa process:

How long does the process usually take? From filling out the forms to arrival in the USA?

Second, and perhaps most importantly, is it possible for one, as the US Citizen petitioner, to do what needed to be done in the US, and then go and wait with one's fiance in his/her country?

I certainly hope so. I can't imagine having to wait in the US without seeing one's fiance, with no end in sight.

  1. Six to eight months is not all that unusual once the petition has been filed. Certainly, the American can come visit you while you're waiting. He's an American and pretty much free to travel as he wishes. He can be there when the interview takes place, if you like, although there's no legal requirement for him to be there and usually the petitioner is in the US when the interview takes place. Of course, if he's there the entire time, he'll probably be pretty broke by the time the interview takes place. You might wind up supporting him.

  2. hi, back in 01 we filed mine in march and it got the letter to go to the embassy in begining of may of same  year.Dont know about the second part  .But i dont see why not, i think you can maybe even file from germany . But the alien petitioner has to stay in his/her home country.Unless you want to go to the US fly back for the interview and medical in germany and then fly back again.

    He its worth the wait

  3. It would not be harmful to your chances of receiving an approval of the petition if you submitted the I-129f to CIS in the U.S. and then departed the country to be with your fiance. Of course, any correspondence sent to you by CIS would go to your U.S. address so you'd need someone in the U.S. to read your mail.

As far as you waiting in Venezuela, that's up to the Venezuelans. They have immigration laws there too.

Here's their ENTRY/EXIT REQUIREMENTS:  A valid passport and a visa or tourist card are required.  Tourist cards are issued on flights from the U.S. to Venezuela for persons staying less than ninety days.

Persons traveling for reasons other than tourism, however, should consult the Venezuelan Embassy or nearest Venezuelan consulate regarding possible visa requirements for their specific purpose of travel (http://www.embavenez-us.org).

Venezuelan immigration authorities may require that U.S. passports have at least 6 months validity remaining from the date of arrival in Venezuela.  Some U.S. citizens have been turned back to the United States if their passports will expire in less than 6 months.

You may want to apply for a tourist visa which is granted for one (1) year, with multiple entries. For each entry the tourist may stay in the country for a period of up to ninety (90) days.

The visa may be extended for an additional and equivalent period of time by the appropriate Venezuelan authorities (Ministry of the Interior and Justice).
