Keeping tenanacy deposit

i have just moved out of a tenancy rented property after being there for 18 month not once did they make a inspection (they should be quarterly) they are now saying they are taking my deposit for carpet cleaning??? i have taken photos as 1 bedrroom is spotless i understand there is a minor mark in another can they do this? especially when never made inspection

  2. Your issue is whether you can challenge this. The answer is yes. Under the law, a landlord may retain a deposit for excessive wear and tear. If your photographic evidence indicates nominal and reasonable wear and tear, you should file an action in your Small Caims Court.

    A cleaning fee is distinct from a deposit. If they intended all along to charge you a cleaning fee at your lease's end, it should have been so identified, properly identified and mutually agreed to within the lease.
