Kidney stone and bad doctor.?

Ok here goes. My girlfried was recently diagnosed to have a 5mm kindney stone in her left kidney. Surgery was scheduled 2 weeks later to remove the stone by going through the ureter. A day before the surgery she went in for her pre-op. She asked the doctor(or nurse) 3 times during her pre-op that would it be good to do an Ultrasound to see if the kidney stone is still there and they said that with a stone this big it would have been impossible to pass without any pain. Well the next day comes around and its time for surgery. When its over, the doctor comes out and tells her family and I that he scoped out the entire kidney and did not see a kidney stone. needless I was furious. Not at the fact that it wasnt there but at the fact that she asked 3 times the day before to get an ultrasound just to make sure it was still there and they wouldnt do it. she was upset to have a stent in her for a week for no reason and to have pay that much ($2000 co pay) for no reason. The whole family and I were upset but we left it at that. Fast foward to this week. The same exact pain starts Wed. night and we go to the emergnecy room. We set there for 3 hours and leave because they are not going to be able to see her even though the amount of ain she is in and after vomiting 5 times in the E.R waiting room. So we go home to go the next day. Get to the E.R, they check her immediatly and start to perform tests. In turns out that the kidney stone is still in there and that her kidney has an infection in it now. The ER nurse called the doctor who performed the procedure and assured us that the stone was no longer there to come to the ER and see her and he REFUSED!!! I was pissed to say the least. So now her and her mom are waiting to be released and she is gonna have to go the weekend before she can see a "real doctor" i.e:her doctor. the *** who didnt know what he doing. OK for the question LOL. Is there any legal action that can be taken against this doctor and his office? It has caused a whole lot of pain to her, me, and her familiy.

  1. Sounds like a great case for any lawyer that works on a contingency fee.

    Make sure you have a file with all communications with that doctor and his staff.
