okay so i was wondering if in australia, a teenager is caught with wielding a knife. what are teh charges and consequences of this

  1. You will  need to specify which State or Territory, as the Criminal law is different in each.

    It will be different if the 'teenager' is under 18, or if they are an adult

    Also, it would help if you explain what you mean by "caught with wielding a knife"

    The situation can be very different depending on whether you were 'caught with a knife' or 'wielding a knife,' which might constitute an assault

    In South Australia, the usual charge is "Carrying an Offensive Weapon"  There is a more serious version if it is near licensed premises.

    The charge can be dealt with by Formal Caution, Family Conference, or an appearance in the Youth Court.

    There is no rule in South Australia about the length of a knife.


  2. Every State and Territory in Australia is slightly different.

    In New South Wales there are separate charges for carrying a knife in a public place and wielding a knife in a public place. Wielding is defined as openly carrying the knife so it's visible to others, or waving it around etc.

    The offence for wielding is found under Section 11E of the Summary Offence Act (1988): Wielding of knives in a public place or school.

    ...and carries a $5000+ fine or a maximum 2 years imprisonment or both.

    A minor committing such an offence has the possibility of a youth caution or youth conference under the Young Offenders Act in certain circumstances.

    In NSW odds are on you're having the knife confiscated and you'll be charged.

  3. My Daddy grew up in the country carrying a pocket knife. Old men used to sit in rocking chairs on a porch and carry a knife and cut wood things. I would appeal this as over history the knife has been used to cook, and create wooden toys and things. Get a good lawyer. Good Luck!

  4. okay you were basically caught carrying a knife...

    the charges will be possesion of a deadly weapon.. if they choose to press the charges and if or the knife is over 2 inches long depending on the state in which this occured...

    now the sentencing on a guilty plea.. can be anything from probation to a continuence witout a find or a dismisale.. depending on your record..,..and this can escalate into possibly doing jail for nless then a year perhaps only if anyone was hurt.. or if the defendent has a pretty lenghty rap sheet..
