Question:

L2 Visa question?

Hubby and I are both on L1 visa here in the United States. Both of us work for the same company, different clients.

I'm having certain medical problems and I'm planning to take a break from work (ie., long leave without pay) for a year. Hubby will however continue to work.

My question is

a) Considering that my L1 visa is valid until 2010, will I be able to convert my visa status from L1 to L2 without leaving United States?

b) Should L2 be company sponsored (based on L1's status) or we(hubby and I) can get it done ourselves? Meaning, if our company refuses to apply for L2 for me, I cannot do it myself by paying for the expenses from my pocket?

c) Hubby has to get his visa stamped again as his current visa status is gonna expire soon. I'm planning to file for my L2 at that time. Now, when my hubby appears at the consulate for his stamping, I can go along with him, or do I have to wait for him to get his stamping done first?

  1. 1) You can change you status by filing Form I-539 with the USCIS - read the instructions carefuly before filing.

    2) A company is not required to sponsor you for your L2, it will only cost around $300 to change your status.

    3) Yes, you can go along with him to the consulate and get your visa stamped too.
