  1. It is not evading arrest if you are doing it for this reason but it also depends on how you go about it. If you start speeding off towards a townline then it may look a little suspicious. I was always told to do this too, pull over to a public area where there are lights. It would probably help to acknowledge them somehow, maybe wave them to follow you? Usually as long as you don't go speeding away as though you are trying to lose them and you explain your reasoning when you finally pull over it is ok.

  2. thats not evading arrest. she probably wouldn't get arrested if it was just a routine traffic stop... however.. for her safetly.. she should never pull over if it is an unmarked police vehicle.. and if she feels threatened.. pull into a public place. .like a busy gas station or someplace with a lot of people around.

  3. You can look for your state's statutes. In some, you're not required to stop for an unmarked car. (Note that some agencies are using cars with large but very subdued markings for traffic. They're going to be more tolerant of people being hesitant to stop.) But in general, you're required to stop. If there's a lighted area with people around in sight, there's no problem driving slowly on toward it. But you can't justify driving ten miles, just because the officer in the marked car with full emergency lighting is a male. Probably not an issue most places, since long before you get there, you'll have plenty of police company. Since nearly everyone has a cell phone, she can always call 9-1-1 and tell them there's a car trying to stop her. If they say it's the police, stop.

It's different with an unmarked car with just a Kojac light or red spotlight. Definitely drive on to lights and people, then. It might be Constable Dawg, but it might not. At any rate, someone who opts to drive on for a while needs to be prepared to do exactly as ordered when they stop. Things will be a little tense.

  4. Our department uses several unmarked units for patrol.  If an officer using one of these was to turn on emergency lights behind a vehicle at night, we would not have a problem if the driver was to drive to a lighted area before stopping, as long as they did not accelerate or attempt to flee.
