LAW question about non EU drivers that cause accidents and are uninsured?

My husbands whilst driving was hit by a turkish lorry driver who appears to have dispalyed the incorrect number plates for his cab and trailer and therefore is uninsured. It may be classed as hit and run and therefore husband gets left with some of the solicitors fee's. Can he take the company who contracted this driver to court for not checking he was fully insured. I am sure that there is a case study about this, but am unsure where to find out about it. Any help would be great. My husband is now incapacatated due to this and it is unlikley that he will work again as he has to have plastic knees, but also has permanent back damage too. We just want someone to take responsibility to stop this happening to anyone else.

  1. You need to deal with the Motor Insurers Bureau on this one. They collect a fee from all motor insurance premiums to cover the losses due to uninsured drivers. You would be best dealing through a solicitor as it looks as if there might be a criminal offence involved


  2. If the driver was an employee of the company, then yes, the company is accountable.

    If the driver was an independent contractor, then the company is not responsible for checking.

  3. It is the uninsured you need to pursue but also there is a body that can help financially and it is: The criminal injuries compensation board as per the link.

    Don't get too bitter it will make you ill and rember the many thousand British citizens commit the same offence.
