I know I could contact the Dept. of Labor or a lawyer. But it's a weekend and hoped some of you would know this..... If a person works for a small to moderate sized private company that is a member of the BBB and in a post secondary school (vocatationa0), and the company refuses to hand out paychecks or release any pay to any of it's workers and does NOT offer lay-off's to allow workers to colect unemplyment, what can be done legally and also, what would you do? Not showing yp for work would only hurtthe students. The reason given in lack of money due to poor cashflow. The CEO lives out of state and keeps giving excuse after excise to the school's CFO and director as well as the epmployees. For many, this is the THIRD payroll period where checks were not issued or honored if issued.

  1. Labor board and attorney..........

  2. Failure to pay for hours worked and failure to follow overtime laws are basic employment laws that state government is well equipped to help you with.  They will pursue the complaint whether you file alone and may give you even a higher priority if you complain at the same time as the other unpaid employees.  This will get you paid soon and without any legal expense.

If you want to bring additional pressure, this type of story may be of interest to the local press, more to embarrass the school into paying than to win your case wage and hour case.

Whatever you do, do it soon, since you mentioned poor cash flow.  If the school goes bankrupt, it will take a long time to collect your pay since a bankruptcy court will be involved.
