I gave a gf my pin number a few months ago because i trusted her, she also had an extra key to my place in case I needed her (I am diabetic). This past friday she let her boyfriend in to my house and stole my purse so he could clean me out (over $750) and now I cannot get my son to a very important appt. at Childrens hospital! Can I reterieeve my money from the bank? I gave her the pin but she gave him the pin and he used the card????

  1. have them both charged with fraud!!!  this will add pressure on the bank to refund money -- good luck with your child!!!

Sorry, the bank won't replace your money - it wasn't THEIR fault and they did nothing wrong.  You could sue her bf for it, but if he doesn't have it, that won't get your money back either.  And sounds like he's already being legally charged, which is good but again won't get your money back unless he's convicted and part of his sentence is restitution.

    It would be possible to charge both of them - but that still doesn't get your money.  You are the one who screwed up by giving her your pin - I guess you know that now.

  3. If she would have done it , you may not have any recourse. Beings as you trusted her with it and she betrayed you  she is responsible  as long as you can prove she gave him the pin to do the theft. Then they would both be accountable for the theft which is a crime. She is then considered an accessory to the crime even though she did not actually commit the crime. Call the police, have a copy of the tape ready for them to view. Tell them the circumstances why you gave her the pin and that you had no intention of her giving it to someone else. You may have to take them to court to get a judgment for your money, again have a copy of the tape!!!!!!!!

  4. Your EX-friend has made the right first step. If the police will issue a theft report, get the police report and forward a copy to the bank. For a Debit transaction, you don't have the same rights as a credit card, but I think fraud and theft are covered. Even if the police prosecute, you can still take your claim to small claims court to get a judgment against him.

    If you haven't already, immediately change your PIN and locks.

  5. Pin numbers should not be given to anyone.  This is the first thing you are told by the banks. the fact that you were made aware of this and you still chose to ignore this will make it impossible to claim your money back from the bank.  you acted negligently.
