Labor certificate rejected?

Hi, I and my husband are from India. He is working in US from past 3 years. His labor certificate for green card is rejected twice and he has applied it again. Is it true that if the labor certificate is rejected more than once then it is difficult to get the green card? If anyone know about this please reply. Thanks

  1. This is two parts question.

    First of all, you will not have difficulty in applying your green card if your labor certicate has denied before. USCIS is the agency issuing the immigrant visa and Department of Labor is the agency approving the certificate.

    However, you are required to have the certificate approved before applying for immigrants. Based on the situation you mentioned, DOL will unlikely to approve your application. Usually it may relate your your employer (violations) or your industry (no foreign worker needed).
