Landlord asks for security deposit late, can he do that?

We have lived in our rented home for half of the lease and the landlord is just now asking for the security deposit, as it comes at a bad time when money is short, its a problem. Can he do this?

  1. He can't do that unless it's in the lease.


  2. The purpose of a lease is to ensure each person holds up their end of the agreement.  If the landlord wants to charge a deposit, he needs to get you to agree to it, and rewrite the lease.  Of course you are NOT going to agree to such a change, so your landlord is out of luck.

  3. No, that is the reason for a lease...to prevent a landlord from demanding money not previously agreed to, and to make sure the tenant pays rent.

  4. If the security deposit is mentioned in the lease then you must pay it.

    Of it is not mentioned in the lease, the landlord cannot do a darn thing about it if you refuse to pay.

  5. he cannot ask for additional funds that were not included in the lease agreement.  if you renew your lease, he may make changes at that time.
