Landlord died in june, do we have to pay his sister july rent?

ok, so our landlord died the sunday before july 4th, so obviously our lease with him is void. His sister became the owner of all of his properties, and all the legal work just wnet through today, july 31, 2008. She came to the door and demanded that we pay her july rent or we will be evicted. Do we legally have to pay her for july rent if we do not have a lease with her and she did not have possesion of the property till now? we are moving on august 4th as we bought our own house and do not have $625 to hand over to her. PLEASE HELP!! 10 points to best answer.

  1. Well if she has your $625. deposit, that should cover the rent.

    Since you are staying only 4 days in August ask her to accept a partial payment of the rent.

    Pay the rent.

    EDIT:  Legal on her part?  What about Moral on your part?

  3. If you lived there you have to pay we don't live in an apt rent free.

Yes you have to pay but if you dont have the money give her your new address and tell her you will be sending x*x amt of money each mth until you get it paid.  If you put up a security deposit ask her if you can use that to pay for what you owe.  Leave the place clean!!!!!!!!  Tell her you will and have her do a walk through.  Be nice about it and she will be more apt to help you.  

  5. Well, you still need a place to stay until you do move and you have stayed there through the entire month of July, so yes, you have to pay rent. If you didn't want to pay more rent, you should have went and  freeloaded on some of your family if they would have let ya.

    Why should you get a free place to stay just because of someone else's tragedy? Her brother died, she inherited his property, therefore now she is landlord.

    *** Doesn't matter what you see a point in doing. She can and most likely will take you to court for not paying. And frankly, I can't say as I would blame her. You're legally bound to pay for what your using. Just do the right thing already and pay the woman. What's it going to hurt if your sure you're going to get it back when you move anyway?

    And that 30 days notice, means 30 days BEFORE you move. So unless you gave her notice 30 days ago.. yeah, you're probably going to end up owing more.  Now, put on your big girl panties, stop trying to squirm out of paying what you KNOW you already owe (legally and morally), and get that checkbook out and cut her a check, before you land yourself in court being sued.  :)

  6. You have to pay somebody for the rent.  I would assume her since she took over the property.  The worst that can happen is she can evict you, but that takes 30 days anyway.

    Edit:  I hate when an asker doesn't provide all the details of the situation until after they get some answers...I take mine back, I don't care what you do......If you are leaving in 5 days, then so what!!!!!!!!!!!!!!!!

  7. If your Landlord was still alive you would have had to pay him the rent.  She legally owns the property and therefore you owe her the rent.

    By law you need to give 30 days notice if you intend to move or else the owner/landlord can keep your security deposit.  If you gave 30 days notice than you still have to pay the rent and she is reponsible to give you the security deposit plus interest back.
