Landlord question: late rent?

I've been renting a flat from this guy for just over 2 years now, and my lease ends next year, and this month I'm a little late, and can only pay it a week late. I've now let him know this and the exact date when I'll pay, which is the 8th of this month, but he is being so harsh, and asking me to pay at least a week and then the balance next week.

He's not even prepared to wait 5 days for his full rent! And I've been in this flat for over 2 years and never gave him any trouble. But when I asked him a month ago to come and paint a section of my wall, because after 2 years it's gotten a bit dirty, no response. In those 2 years I've only ever been late with my rent once.

Should I move on?

  1. You committed to a monthly rent and you must pay on time.  He is under no legal obligation to give you extra time to pay.  Now, would he evict you for being a week late?  Probably not.  Does he have the right to do so?  Yes, he certainly does in nearly all jurisdictions.

    He's under no obligation to paint a wall that has become "dirty" unless it's due to a defect in the property.  You on the other hand ARE obligated to keep it CLEAN if the accumulation of dirt is from ordinary circumstances.


  2. When you signed the lease, you agreed to pay the rent on time.  He doesn't have to give you any extra time at all.  That is just how renting is.

I understand your point in this situation.  I have been renting from my landlord for 3 years and never been late with my rent but I know her and if I was late she would be understanding and patient with it.  But that is just her!  Others are very harsh and demanding about it!  It depends on if it will make his payments late.  

  4. Sorry but the law allow the LL to collect rent on the 1st of the month every month. You pay the rent on the 8th does give him some hard time cos' he has to pay the mortgage, too.  And he already can give you a 3 day notice to pay or quit and start eviction.

  5. He is likely upset because you are causing him to be late with the mortgage.   Why should he be prepared to support you?
