Question:

Landlord renting despite not finishing code inspection?

I just had a walk out inspection on my apartment. The same day someone new moved in. I left because the landlord, had lots of problems in the place. Two of the biggest were mold issues and electrical issues (including wires that weren't grounded). At one point I had to call out the code inspection, who listed those problems and many others. I was wondering if it is legal for the landlord to rent the place despite not completing all of the list (include the mold and electrical problems). When the inspector returned for the re-inspection, these issues still existed and another inspection is set up for later this month. I am wondering if it is legal to move someone in despite the landlord not fulfilling the requirements of code inspection. I live in Kentucky.

  1. Maybe, but it is not your problem.

  2. Was the place condemned? Did the code enforcement officer place a big, bright sticker on the front door?

That is between the code enforcement office and your landlord.

It would be hard for the landlord to hide the fact that the place is occupied from the inspector when he comes again next month.

  3. I guess the other person who moved in was not as concerned with their own safety and health as you were...or they were showed a model apartment and did not ask to see the actual apartment they will be renting to see if it meets their standards before they signed the leasing contract. The current tenant will have to bring up those compliance issues with landlord.
