Landlord wanting to sell?

Im renting a property as short hold tenancy, I have done the first 6 months of my tenancy and now its a rolling contract. My landlord has recently told me he wants to sell but has not provided me with my notice yet. The flat is curently up for sale and the estate agent keeps ringing us to arange people to come round to view the property. What are my rights with regards to this, I work full time and on my days of want to spend it with my family so am not always around. The estate agent keep ringing and ringing and trying to arange loads of viewings. I am wondering if this is allowed yet because we have not been given any notice yet and this has been going on for the last month. Is the landlord allowed to have people viewing the property without even giving me a notice, what are my rights?

  1. The estate agent should be ringing yourt landlord, not you and your landlord needs to give you adequate notice that he/she will be showing people around.

    It is not your responsibility to be there or to make appointments.


  2. The landlord/agent has to give you a minimum  of 24hrs notice, but until he has given you notice to vacate, he shouldn't be doing anything. Also I you are not happy with the agent or landlord doing viewings, then it is your right to refuse entry, you need to do this in writing to your landlord/agent. When the agent next rings, say that you have not been given notice that the property is for sale, therefore until you have that you request the agent from ringing again.

    You are perfectly within your rights.

  3. The landlord (or its agent the real estate agent) must give you 24 hours notice to enter the property.

    Until the property enters escrow, there is no other notice that is require. Upon entering escrow they will need to give you a 30 day notice to vacate.

    Or, he MUST give you notice of sale, and that you will be under a new landlords rules. That is called a "buy-to-let" house. He cannot force you out without notice and he cannot sell/arrange viewings without your consent.

    I would phone him and tell him your feelings on this, and also to phone to estate agents to tell them that you havent given any permission to allow viewings on the house, as he hasnt yet asked you.

  6. First check the contract. It is most likely to say viewing will be alowed at reasonable times.

    You don't have to be there when people view, however you may feel you want to be.

    The landlord is not going to give you notice until he knows he has sold the flat.

  7. The agent needs to give you 24hrs notice before showing anyone round that is the law. The landlord is allowed to have people viewing the property and as long as  you have been given the adequate notice he remains within the law. Legally You do not have to be home at the time of viewings the agents can do the viewings without you being there as long as he has given you 24hrs notice..... Its the agents job to show the people round and they do try to get tenants to do their jobs for them sometimes..I would tell them even if in that they need to come and show the person round and go for a walk or chill outside..after all they will get a huge payment once they clinched the deal..let them earn their commission..

    The landlord has probably has not given you notice bcoz with the situation today its taking up to 6 months to get an offer on property and still many are falling through as pple are gazundering each other...(that is offering a price and agreeing the price and close to completion demanding the seller reducing the price by X or they will walk away)...so it maybe a long time before he actually sells it...

    I would contact the landlord and discuss the viewings bcoz it will take a long time to sell the property..and in the mean time you may have tons of viewings.....
