Landlord wants to sell flat im living in and wants me out?

he said he would get me another flat so went to see the flat on saturday and its in an awful state and needs lots of work done to it.i really cant move in to that place

can my landlord just throw me out,I'm really scared i have a 10 yr old daughter too.

  1. Depends what your contract says.

You are in quite a strong position.  The landlord has to give you the required amount of notice (not sure if it is one or two months notice) but that does not mean you have to leave then.  He then has to take you to court to get you evicted.  Talk to your local council and fill in the council housing form.  Do not move without somewhere safe to go to or you will be seen as making yourself intentionally homeless - that is really important.  

    You need to get some proper advice so talk to Shelter or your council's Private Lettings Office now.

  3. Your landlord can terminate your lease, but the landlord is required by law to give you at least 30 days written notice.  If you are not given 30 day written notice then you have a right to sue your landlord if you are locked out of your apartment.

    I would suggest looking for a new apartment and upon finding one, give your 30 day written notice.  If there is a lease involved make sure before apartment hunting you legally break your lease with written documentation signed & dated by you, your landlord, and a notar republic.  


  4. If you are under a lease he cannot throw you out. I would suggest trying to work with him. Tell him what the problems are in the new unit and see if he is willing to repair them. If you are under a month to month rental agreement he only needs to give you 30 days written notice to vacate. Maybe asking to be let out of the lease and given 1-2 months rent free while you look for a new place would be the best way for both of you.

  5. Agreed with the others, depends on the tenancy agreement in place. If it has ended, or if there is a clause in there for the landlord to end the tenancy agreement early, then all the landlord needs to do is give you sufficient notice and you'll have to leave. If, on the other hand, the tenancy agreement still has time to run and there is no early termination clause, then he won't be able to evict you until the tenancy agreement ends, and even then, he must give you notice.
