Landlord wants us out by the first so he can rent?

We have rented for a year. The landlord hasn't fixed anything for months. He is always concerned about the money but he rarely does his part. Our back door on our trailer fell off and they act like its no big deal. The put some boards to hold it up. The landloard has a resturant I don't see him although his house is at the front of the trailer park. He has family up here that is getting a bit nasty with us. They have asked for the rent money. We told them we will not pay. They told us blank out to move out by the first so they can rent it. Nobody can rent this and nobody would. We have no signed contract. I have four kids. What are our rights? Is there anywhere I can go to for help?

  1. Repairs and rent are two seperate issues.

    You do not have a written lease, however, your state's landlord tenant laws govern your month to month tenancy at will.

    You need to deal with repairs per your state's landlord tenant laws. Some state's laws do not allow rent withholding.

    The states that do allow rent withholding allow it under specific circumstances after specific steps have been taken.

    You do not have the right to just not pay rent. The landlord can evict you through the courts.

    You may have to be served with an official Notice to Pay or Quit before an eviction can be filed.

    A Pay or Quit Notice gives anywhere from 3 - 15 days in which you must pay the rent owed or move out. If you do neither, an eviction will follow.

    30 days notice is not required in cases of non-payment.

    You have the right to deal with repair issues per your state's laws.

    You have the right to pay rent in order to live in the property.

    You have the right to be evicted through the courts if you fail to pay rent.

    By law your landlord has to give you 30 days notice to leave. And 60 days if they are evicting you. I just bought a duplex and i rent out the top half of my house. She has about 2weeks after rent is due to pay or we can start the paper work for eviction. SO no matter the case he has to give you more than a day notice ITS THE LAW!

  3. First of all they have to give you 30 days notice in writing that you have to move out.

    Second, if you hold back rent, go to the bank and open a separate account as a rent account. Deposit your rent there. And Don't touch it!!!!

    Put all of your complaints in writing to the owner ASAP, mail it to him certified mail and keep a copy for yourself. Be sure to get a receipt from the post office saying it was delivered. Ask the mailman about the right form.

    Then go and talk to the landlord directly. Tell him you are following up about the letter.

    If he still wants you out, he has to take you to court and that takes a little time. It may give you an extra month after the first 30 days.

    Call a lawyer and ask for advise. Some dont charge for the first consultation.

    The key is to document everything!!!!! All conversations, all emails, all letters, all voicemails, all IM's EVERYTHING. So if you do have to go to court, you have everything you need.
