Last will and testament.?

Hi,Is there a lawyer out there.

My brother left a will, his beneficiaries being, his two sisters, and his brother.

He has a deceased brother.

The children of the deceased brother are contesting the will.

Do they have a claim?

They are all married and have jobs and children.

  1. They may, you'd need to look at the exact wording of the will.

    The reason you often hear of people receiving $1 out of an estate is to prevent this kind of thing from happening. If they have been left $1, then their existence has been acknowledged in the will and they get no more. If the will is mute, then they will probably try to argue that they are entitled to their dead father's share.

    Good luck with that. If you can't come to a reasonable agreement with them, then you (or the executor) are going to have to hire an attorney.

    If the deceased brothers Name is in the Will then Yes.

    If the deceased brothers Name is not in the Will then NO
