Law forcing fences around hot tub? ?

My family has a hot tub that sits on top of a stone patio behind our house. There is a fence that encloses the patio as a whole. I have suggested to my mother that we remove the fence because it is a nuisance more than anything. She claims that there are laws that force hot tub owners to place some kind of fence around a hot tub area. Is this true? Is there a state that has these laws?

  1. You bet. Where I live in WA State, the local building codes specify a fence at least 4 feet tall with a locking gate be placed around any pool, pond or hot tub to prevent children and pets from casual entry and drowning. I do not recall reading if a locking hot tub cover meets the requirement. This does NOT mean the entire property has to be fenced, but a fence around the entire property meets the requirement, just as a fence immediately around the pool itself would do.


  2. in the state of texas if you dont have a locked self closing fence  around your pool or hut tub and code compliance sees this that is a stiff fine it reads as follows pool or hot tub must have a self closing gate to prevent drowning

  3. It's a code compliance issue. It's to prevent little kids from wandering onto the property, falling into the hot tub, and drowning. If your mother removes the fence and someone gets hurt by wandering into the yard and falling into the hot tub, your mother is liable for the injury or death.

    One way around needing a fence is to get a locking cover for the hot tub.

  5. Yes, Florida has a law requiring a fence around hot tub, pool, or any other "attractive nuisance" that might appeal to children.  

  6. That is quite possible.  There is a law here that says we have to have them around outdoor hot tubs as well as any of those blow up type pools.  It is considered a safety measure so kids are not climbing in when you are not aware.
