  1. The Fifth and Fourteenth Amendments require "due process" of law for all citizens accused of a crime or facing the loss of property.


  2. Article 3 of the constitution establishes the Supreme Court with power to govern the federal judicial system. Congress, in the Court Act (one of the oldest laws on the books), establishes the remaining federal courts and provides their jurisdiction and sets up some of the rules governing who can hear what cases both originally and on appeal. What the Court Act is silent on, the Supreme Court decides. State court systems are each set up seperately, but generally through a similar procedure. The highest court in the state is usually established by the state constitution and the judicial system is governed by that court with some aspects governed by state laws.
