Law question about rights at work?

Hello, my question is I have been working in retail at the same place for a year in October, and in September I want to go back to college one day a week. My contract days have changed several times through my time working there, due to the fact of staffing problems. I have now requested to have Mondays off work as this is when my college course is. I spoke to my supervisor and she said that it should be fine as long as i put it in writting, so I wrote it in letter to the manager stating why I needed that day off and that I can change my day and work a day that I would normally be off. After the assistant manager read this he refused to give me Mondays off and said that the company can not do anything to help me. Is this allowed? There are other people in the store who have changed there contracted days. I am 17 and I feel that i am being made to give my notice in just to continue my education.

  1. Of course they can do that.  Work come first.

    They can make you work any days and any hours and can change your schedule at any time.

  2. NO THEY CANT DO THIS UNDER THE LAW THAT YOU ARE 17 AND STILL GOING TO SCHOOL IT IS MANDATORY FOR THEM TO PUT YOU FIRST THAN OTHER ESPECIALLY IF THEIR ARE PEOPLE THAT HAVE HALF THE TIME YOU DO.

    AT A WORKFORCE CENTER THEY CAN ACTUALLY GIVE YOU MOE INFO.

    IF YOU DON'T TAKE A STAND RIGHT NOW THEY WILL WALK ALL OVER YOU. PLUS YOU ASKED THE SUPERVISOR NOT THE ASSISTANT THEN GO BACK TO THE STORE MANAGER AND TELL THEM WHATS GOING ON IT MIGHT BE THAT THE ***. MANAGER DOEST SEE IT FAIR


  3. You are asking to change your contract terms and the company is refusing. The company is not obliged to agree with your request although, in the absence of any other information, it does seem a little unreasonable.

    Given that you have not worked there for a year then you have very few employment rights.

    What you could do is to use the company's grievance procedure to request that your request be reconsidered. Even if the grievance is dealt with by the same manager who refused your initial request then if he refuses again you will at least get the opportunity to appeal the decision to a higher level of management.

    However you will, of course, not be endearing yourself to the assistant manager!

    The company have the right to decide who works which days.

    You are not being made to give in your notice. You have a choice to make.

It sounds like you work for Makro, the best thing to do is get a job that suits your personal life better.  At the end of the day, you should not compromise your life for a transient employer, its not like your career is based with them or is it?  The fact that they are not willing to invest in an employee’s future tells me you should be elsewhere.

    Have you actually told them you will have to leave if they cannot accommodate you? Call their bluff. You have nothing to loose.  If you do leave, the satisfaction you will get from telling them where to go is immense, believe me..Addictive actually..lol

  8. Yes, they can do this. If you have a contract, and it says you will work specific days, then you have to work those days. But, like any other contract, it should be negotiable. Talk to the person above the assistant manager, and if you get no help from anyone, start looking for employment somewhere else that will be flexible enough to fit your school schedule.
