Laws as a person in debt?

I recently got an e-mail from a creditor about an account I have. I had a huge life change a few months ago and things are still very rough. I don't have the money to pay them a dime right now, trying but I can't. I recently received an e-mail from them and am unsure if they can legally do this:

Have you heard there are Federal Laws regarding FRAUD? Just wondering. I bet the penalties and punishments are STEEP, wouldn’t you? I wouldn’t want to be charged with anything like that myself, think I would take care of my business, wouldn’t you?

So, how are you? Everything going ok? Hope all is well and have a GREAT day!

Is this kind of e-mail from a creditor illegal? I felt it to be harassing and threatening. I could be wrong.

Please don't slam me for not being able to pay my debt. I'm working hard and I am trying.

  1. I agree, it seems a bit harsh. I'm not sure what you could do about it, however.

    Why don't you call them and ask for a forbearance? Let them know you're having a hard time right now and that you'd like to pay but right now you don't have the means to pay.

    Who knows, they might have a program to help or something, so it might be worth a try.

  2. I think this is borderline.  He's not outright threatening you, but the character of this email is mocking and accusatory.  

    Have you considered bankruptcy?  The collection activity would stop.  Think about talking to a bankruptcy attorney.  Most of us offer free consultations.

    I advise you to make no attempt to respond to your creditors and talk to a bankruptcy attorney as soon as possible.  It's nothing to be ashamed of.
