Lawyers, please help me out ?

this girl will not stop harassing me via text message. How would I go about sending her a letter from a lawyer requesting that she no longer talk to me or that I will press charges for harassment.

She's also spreading lies about me, defaming my character. This has been going on for about a year. She also told a group of my friends that she was planning to poision my dog with tainted lunch meat. Tells friends parents that Im an alcoholic when on quite the contrary she's the one who is snorting oxycotin like the world is ending.

Help make this nightmare stop, please.

  1. You can call your phone company and ask her number to be blocked.  Another avenue is changing your own cell number so she can't any longer.  Go to the police department and ask to file charges on her based on harassment and terroristic threat.  She threatened the life of your pet, it counts.  Defamation of character is a civil problem, you can sue her in a JP court as long as you have proof.


  2. What state do you live in?  That will determine who can help you and what remedies are available to you.  

  3. Repeated texts with intent to harass is a crime in most states (In Texas, the crime is called "harrassment").  Call the police and have evidence of the text messages handy...you can show them recent texts and you should eventually get them printed out through your phone company.

    As for defamation, you might be able to sue her, but you don't give enough information here.  You should talk to a lawyer about it if you want to go that route.

    As for the "plan" to poison your dog, you're probably not going to be able to do anything about that until she actually starts taking affirmative steps to carrying out that plan...at least not on a "legal" level.  And good luck proving that.

You need to actually consult with a lawyer before they will agree to send a letter.  You will have to convince them that this girl is actually doing these things or they will likely not be willing to assist you.  And of course, unless you have a friend or relative who is a lawyer who will do this for free, you will have to pay for the service.  Keep the text messages and, if possible, get friends to write up statements and sign them before a notary public, the set out what she has said about you, threats she has made, etc.  And they have to have heard the comments first hand - it cannot be hearsay.

  5. You may be able to get a restaining order then if she contacts you she could go to jail.I would contact a  lawyer in your area.
