I am divorced. From our marriage me and my wife financed a new car, with me as the primary signer and her as co-signer. Through our divorce she was awarded that car and was to hold all responsibilities for it. It is stated clearly as that in our legal court ordered divorce papers. Now, several months have went by and apparently she has not made any payments on it. Since it is also in my name the finance company has contacted me looking for payment. That is the story, now my question is to you....what am I suppose to do? The court said she is no longer my wife and that is no longer my car nor my responsibility. I have explained that to the finance company and they still are threatening me with jail time...why is this?

  1. Make a copy of the divorce papers along with the Judgement in which this is stated... highlight it and preapare a cover letter putting in writting everything you have said (i.e. your finance company continues to contact me regarding the **make, model, license plate, VIN of the subject vehicle**, I have advised them that per the court order entered on **enter date it was filed w/ the court** I am not legally married to **ex wife's name** and the vehicle is no longer owned by me... Please discontinue to contact me as I feel I am being harrassed by your company...

If possible, contact your ex wife and have her change the vehicle to her name... also, send a copy of the letter to the DMV also.  Create a paper trail of all your conversations w/ the finance company, by putting your conversation in writing (along w/ date and time of calls) and keep it for your records.

The finance company will more likely get discouraged...
