I've signed a lease, but the leasing company immediately took it from me - saying that they needed to have the landlord sign it and then they'd send me the completed copy - but they've never given it to me, I've asked repeatedly & emailed, but still nothing. I believe in this case that it's not legally binding - is this true?

  1. "I believe in this case that it's not legally binding - is this true?"

Although technically you are correct, it is not a legally binding agreement because it does not have two signatures or the signatures of both parties. If the other party were to sign it, it then becomes legally binding. It would then be up to you to prove that the second signature was postdated, how would you go about that I don't know.

  2. if they have a copy, then it is binding. if you don't have a copy that is just your problem
