Leaseholders asking me (non-leaseholder) to leave in ten days?

hi,

i moved into a house in western australia 10 months ago, i signed onto a lease with 2 housemates for 6 months. 6 months passed i was never asked to renew or sign another lease, however one housemate knows the realestate agent and got his name on the second 6 month lease. the other housemate is a good friend of mine, but me and the guy who is now on the lease now don't get along, and now he wants me out in ten days, so his friend can move in

10 days is short notice, do i have any rights, 30 days notice would be better, but im not on the second 6 month lease so im not sure what i can do.

  1. As a landlord and a perthite i can tell you that you do not have a leg to stand on.

    You are not on the  renewed lease, your  original lease was for 6 months originally and you have overstayed your lease.

    Ten days is short notice but legally you should not even be there, sorry but next time be more careful who you pick to live with.


  2. In the US even if you weren't on the lease evction takes 30 days.

Tricky one!  Technically the new lease should not have been signed without you confirming whether you wished to come off the old lease.  At the same time it's hard to go about this practically.  I suggest confronting the agent and asking why you were not informed of a new lease being signed in one name only, and asking what they are going to do to help you.

  4. Call Fair Trading in your state. I'm sure that the Tenancy Act in Australia states that a minimum of 6 weeks must be given but it might be different in each state.

  5. I don't know about laws in Australia but in the US even squatters have to be evicted and that takes time. Look up Tenants rights in your area.
