Leave the scene with no report?

It is my understanding that if you leave the scene of an accident with no report there is nothing you can do about it. Is this wrong? Why am I getting mixed replies? Thanks for all your answers!

  1. If you leave the scene of an incident with out having a police report filled out it can and more then likely will come back to bite you.

    The case will have no official at fault party so it will be your word against the other partys. Even if you wernt at fault they might lie better and you will wind up paying.

    never leave without a police report.

Incorrect....not every accident needs a police report.  If there's no injuries, there are times when the police won't even come.  If you leave the scene without stopping & exchanging information, especially if your at fault, it is considered hit & run which can be a felony depending on the circumstances.

    People need to remember, a police report is 'heresay' unless there are viable witnesses.  They take statements from all parties involved, yet a lot of time (with no witnesses) reports are 'inconclusive'.

  4. Well, the question is vague, that's why you're getting mixed replies.

    If you leave the scene of a property damage or bodily injury accident, without giving your information to the person you hit, that's illegal.   Highly illegal.   You can try to fix it later, by putting in the claim, calling in the police report, etc, but if the police want to charge you, they can, and you can't do anything about it.

    You CAN leave the scene of a property damage accident before the police get there, if you give all your information to the other person.  IN many major cities, the police won't even come out, unless there's bodily injury or a car isn't drivable.

  5. No, but if you leave the scene without a police report it then becomes a "he said - she said" situation where it's your word against what the other party is saying.

    Always a good idea to have an official police report that shows who did what when in case questions come up.

    But it doesn't mean there is nothing you can do.  It can still be reported to your insurance, and if their investigation shows you not at fault, they will assist you in collecting for your losses even without a police report.
