I am a American citizen. My main question is that can I leave for a week before my 3 month visa expires in Poland and go back to the US and come back to Warsaw and have a fresh 3 months to stay again? I hope this is in accordance to the shengen agreement.

  1. The restrictions were put in place for a reason, not to just be circumvented by a casual departure and return.  You may not be discovered, but you run the risk of being banned from the Schengen Zone all together.  See the answer above for specifics.

  2. as an US citizen, you do not need a visa for visit Poland;

    On December 21, 2007, Poland joined the Schengen Zone.  U.S. citizens do not need visas for stays of up to 90 days for tourist, business, or transit purposes. That period begins when you enter any of the Schengen countries:  Austria, Belgium, The Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, and Sweden.

    so therefore, going back to the US seem to be your only option,

    if you wanted to go back to Poland,

    yes it would be in accordance with the schengen agreement,

    the only way would be to get completely out of the schengen zone and wait for a while to go back, and then go back? but you must have a return ticket to the US, so you might as well use it anyway,

  3. Why go all the way back to the US?  Why not just slip across teh border into Germany or the Czech Republic & then just go back again.

  4. The Shengen rules state that a visitor can stay in the Zone for up to 90 days in a six-month period.  So going outside the Zone for a short time and then returning, will not work to re-start your clock.  And, of course, since Germany and the Czech Republic are Schengen members, you already know that going there won't work.
