Left turn yield on green, who is at fault?

I pulled up to a left turn yeild on green traffic light so i stoped and waited for traffic to clear. I saw that there was a break in traffic so i started to merge into the intersection. the last car that i was waiting to pass started to slow down so i looked up and saw that the light had turned yellow so I merged farthur up and when the light turned red i maid my turn so that i would not block traffic. i was watching the truck slow when i stared my turn then all of the sudden he speed up and hit my car, thus running the red light. who is at fault? Are there laws or links that can help me prove my case?

  1. It looks like a no fault accident to me. Both of you should not have been where you were. Therefore charges should not be laid and the insurance should take care of your own vehicles. Having said that, maybe next time stay in the intersection and wait til all honks break loose, then move out of the way. Just a thought.


  2. You are both at fault, but the truck more so than you.

    You, because you entered the intersection before it was clear, and the truck because he entered the intersection on something other than a green light.

    If there is a traffic camera or other witnesses that can prove that the truck entered the intersection on a red you can win. If there isn't, it will be your word against his.

  3. It would be your fault, you are not to be in the intersection at all until it is completely clear, you are to stay behind the line.

  4. i would say it's the truck's fault because he or she definitely ran the red light and you were only making your turn to clear the road (you're right, you can't just wait there in the middle of the road during a red light!!). on the other hand, you knew the light turned yellow yet you still moved farther up. unless the road was totally clear, you should have just waited until the next green. that was just me playing the devil's advocate, but i think you can use my former argument to state your case. good luck!!
