Legal action regarding food poisoning from a restaurant (boston pizza)?

my hubby got a bad case of food poisoning from boston pizza. i called them after being at the hospital for many hours, and the manager insisted that it was impossible to get food poisoning from his restaurant and wouldn't even check into what my hubby ate to make sure nobody else go sick. we both took the day off work yesterday, and he's still at home today. because of that we're out quite a bit of money.

is there anything we can do legally to recoop our costs? we're in canada by the way.

    MARCH IN--threaten to make a scene if you don't get

    some action--get a note from the doctor...proof you ate at the

    restaurant....food poisioning has a time line--get all your facts straight--then tell the manager you are going to go public

    because they refuse to listen to YOU!


  2. unless there are many customers that also got sick on that day, its tough to prove you got sick from them.

    Just don't eat there again. They lose a customer. There's the punishment

    You also need to find out of other people got sick from eating there the same night your husband did.

    If infact it was food poisoning and others got sick also, you can recoop your medical cost

  5. Restaurants must have an automatic denial they do anything wrong. The bagel is my avatar is properly toasted, according to the McDonald's manager I showed it to. As far as others not getting sick, hey, could be possible you wee the only one who got bad food, or the only one who contracted an illness.

    Sounds like you need to get in touch with an attorney local to the town your husband was poisoned to pursue this.

Unless you have food left from there that can be tested, you are out of luck.  You can however, call/write the company and voice your concerns, you can also contact health department and file report and ask to be inspected.    I would call company and ask for legal department and voice concerns. Also, if you establish proper communication, they may ask for medical report from Dr and offer you monetary consideration.  Be polite, do not accuse and just explain.  The more proof the better. Also prior to this, go back to doctor and ask him to put in writing that it was food poisoning from food eaten in certain time period. If you have receipt this will help document time of food purchase.  Good luck

  7. It is possible that you could threaten to frighten them. Otherwise, you might consult a wise person.

  8. I would write a letter to this pizza chain and tell them you are looking at legal action. You need to talk to an attorney about this, but  by all means write a letter and send it registered mail. Mention the day or evening you ate there, about the time you were there, what you ate, and anything else that could be pertinent. At the very least you should get your money back. You have nationalized health in Canada, though, so medical costs are NOT an issue.

    Of course you can get food poisoning in the restaurant. Any one can get it anywhere.
