Legal advice needed please!!!!?

Ok my car was involved in a collision with an AA vehicle (their fault as they did not attach the towbar correctly) After going through their insurers they have offered me £611 for repairs. I have gathered 2 quotes from local garages and they estimate the repair cost of £1,100 - £1,400. The insurers have valued the car at 1,000. I havent a clue what to do next as it all confuses me slightly. If indeed the repair will cost this much they said it would be written off and would offer me £1000, however the car is insured for £1,500 as its Limited Edition. This has been dragging on for nearly a month now and i just need some advice to back me up when i next speak to them. Thank you in advance to all that reply xx

  1. HELLO

    YOU REFUSE THE OFFER

    SEND THEM COPIES OF ESTIMATES

THEY WILL WRITE OFF THE CAR AND LEAVE THAT WITH YOU

    THEY SAY £1000,

THEY WILL PROBABLY SEND CHEQUE FOR £970 AND THIS WILL INCLUDE £30 FOR WHEN YOU SCRAP THE CAR

ASK YOUR INSURANCE COMPANY WHAT THE WRITE OFF VALUE OF YOUR CAR IS AS UNLESS YOU HAVE SPECIAL INSURANCE THE WILL GO BY PARKER'S GUIDE OR SIMILAR

SORRY BUT IF YOU TOLD THEM THE CAR WAS WORTH £3000 WHEN YOU INSURED IT YOU WOULD ONLY GET PARKER'S GUIDE IF CAR WAS WRITTEN OFF NEXT DAY YOU HAVE NOT INSURED IT FOR £3000

IF YOU CAN FIND SIMILAR CARS TO YOURS ADVERTISED AT MORE THAN £1000 POUNDS INCLUDE THEM WITH ESTIMATES, YOU HAVE TO PROVE YOUR CAR WAS WORTH MORE, IF YOU CAN THEY MAY AGREE TO PAY YOU MORE.

NEXT TIME YOU GO TO INSURE A CAR ASK THE INSURANCE COMPANY WHAT THEY THINKS IT'S WORTH DUE TO PARKER'S GUIDE AS THAT IS WHAT YOU WILL GET IF IT'S WRITTEN OFF

BACK TO OUR CAR WHICH THEY HAVE LEFT WITH YOU,IF YOU GET ENOUGH MONEY TO REBUILD AT A CHEAPER GARAGE THEN CARRY ON BUT IF ITS WRITTEN OFF THIS WILL BE RECORDED AND MAY NEED AN ENGINEERS REPORT BEFORE YOU CAN PUT IT BACK ON THE ROAD

HOPE THAT CLEARS THINGS UP A BIT

  2. 1) Ask them to repair your car at a garage of your choice.

    and/or

    2) Repair the car from either of the two garages from whom you obtained the quotations.

    3) Ask for Stg. 1,500 as written off value (your insurance cover)

If nothing of the above works, try for a settlement between

    Stg: 1,100 - 1,400

Lastly suggest that it be settled in  a court if nothing else works out. This should make them see sense.

  3. The insured value has nothing to do with the fair market value which is apparently what they are offering you.  But to cut to the chase, Your own insurance company should be representing you in this case.  You bought their protection, now insisit they protect (represent) you.

  4. You'll need a lawyer. Don't accept anything more than what the car's worth.

This happened to me in May 2006, and it was about a year before it was all sorted. My car was worth £2,000 at the time, and I ended up receiving £2,600 because of my lawyer.
