Legal guardianship / custody. ?

I'm 16 years old. lived with my mom all my life.

I want to move out with my sister who is 20 years old.

Our mother has agreed.

But we don't want to have an informal arrangement we want to make it legal.

This is in New York State.

what is the process we have to follow for this?

And approximately how long will it take?

  1. Look into becoming emancipated minor  It is a legal way for a minor to be considered an adult.


  2. You need to contact your county court house for the proper procedures on this matter.

  3. Have your mom call a local social services  agency and ask about giving temporary custody to your sister.

    If your sister is upstanding, you should have no problem, unless there is a law requiring her to be 21 before she can do this.

  4. Only way it will happen is if a judge allows it. Get an attorney and petition the court. If there is Child Support and visitation from your Father involved, it will need to be approved by him also.
