Legal name change after naturalization?

I am a legal resident going tru a citizenship naturalization and i have the option of legally changing my name in that process, i like my name Gwen but i would like to take my grandmothers maiden last name instead of my fathers last name, My question is whether i can change my sons birth certificate to reflect my new last name? and if i can change all my legal documents? I am married however i Only go by my maiden name i never legally changed my last name to my hubbys last name, since i've always had the intentions of taking on my grandmothers maiden name.

  1. Your son's birth certificate has the names of his biological parents at the time of his birth. This is usually done in accordance to the hospital records (if Jane Michaels signs the registrar then that's what will appear on the birth certificate).

    If you're going through naturalization then it's best that you tell the country that you were born in that you want a change of name (and they may be able to change your birth certificate so that both the new name and the old name will be registered (under the same file), do a deed poll, request a change of name certificate (depending on what the laws are in the country of your birth). You also need to tell immigration in the country that you wish to naturalize in so they can merge the files and put your details in your new name.

    As an immigrant it is possible that you will need to register a legal change of name in both countries. Australians in particular are very fussy regarding change of name (and if you live overseas you need the change to be registered in Australia before Australian authorities will accept it).


  2. Probably not the birth certificate.

    You would need to petition the State court where the certificate was issued to do so. I think in some states they issue birth certificates to adoptive parents- so it is something similar.

    But say you got divorced and married again and took the new guys name - would you change the birth certificate....no.

    Good luck with it.

    Although, you could keep your current last name and ADD your grandmothers last name onto the tail to be the LAST name.
