Legal question about piercings?

I have one lobe piercing and one cartilage. Recently I went to soybes for a job interview and I pretty much had the job till she said that I have to take my piercing out because the main store manager hates them. So I told them I wouldn’t and im out the job. Like I understand if I had allot and it was distasteful or if it was a safety issue but it was a cashiers job and it doesn’t require a hat so there’s no safety issue there.

  1. Persons with piercings are not a protected class, since it is a choice to pierce or not.  There is no prohibited discrimination in your example.

    Employers generally may exercise discretion on hiring using any and all criteria except those prohibited by law.

    So, the guy says you will not be considered if you keep the piercing.  He has that right.


  2. they have the right not to hire you. i interviewed people for my old job and if there was something that they weren't going to change then i wouldn't hire them. Even if it is a piercing. I had the right to reject them as i offered the job with a condition, and they declined that condition, therefore they weren't suitable for the job, the same way you did.

    its perfectly legal and for those that are teling you it is illegal have obviously not done law!

  3. It is not illegal for a company to not hire you because you refused to adhere to their dress code.  

    If you find this hard to believe then I don't recommend applying for Disneyland

       - Cast Member may not have facial hair, a visible tattoo, too much makeup, or too much jewelry.  The only jewelry you'll find on men, is a wedding ring. On women: one set of earrings max (single ordinary gold posts), 1 conservative gold necklace max, a wedding and/or engagement ring.

        * One ring

        * No bracelets

        * Earrings no larger than a nickle (They actually measure!)

        * Hair - "dyed" only one natural color

        * Pantyhose - only flesh tone

        * Fingernails - natural, no paint, not longer than [a certain length]

        * Make-up - Mascara, blush, lipstick only -- NO eye shadow or eye liner (they "teach" you how to wear your make-up anyway).

    Same for the Military as well.

  4. sorry, but you're aoutta luck.  i have 15 piercings myself, and i've gone through this with several jobs.  it stucks.

  6. They probably don't want the customers focusing on your piercings instead of the store merchandise. Well at least that's what I heard from previous managers. Many managers don't realize that it's a cultural thing as well. Just find a job where they don't mind. May I ask what City and State this took place. We pretty much don't have that problem in NY especially the city part. The only thing my job hates are Graphic Tee's. They didn't mind my big chunk of Magenta Colored Hair in the front. : )

  8. It isn't an safety issue -- It's a professionalism issue.

    Your old place of employment required a certain sense of professionalism. They don't see a piercing of the face to be professional -- Neither do I.

    There is absolutely nothing you can do about it. It's store policy. At my old P.O.E, they allowed one piercing and two tattoos to be shown at any time -- any more than that and you'd be immediately dismissed.

    Too bad, so sad. You're paying for your facial holes now, aren't you? Stupid decisions end up forcing you to lose jobs.
