as a plaintiff can i invoke" LACHES" legal term AN OPPOSING PARTY that has slept on my rights

  1. laches is a defense, not a claim.  You might have a defense to a counterclaim based on laches but the notion that someone else has an obligation to exercise your rights is just plain wrong.
