Legal question.........there was a fire in the apartment above my apartment

so because of the complex maintenance negligence a fire broke out in the walls of the apartment above mines causing my apartment water damage smoke damage etc. So now i'm forced into a one bedroom apartment my sister has renter's insurance and lucky i fall under her coverage because she was staying with me my problem I agree to move into the one bedroom as opposed to a hotel until my unites fixed etc but now the complex is trying to hurry me into signing a lease for the one bedroom i don't want and their asking me for rent for the one bedroom i have the rent but i don't feel i should pay for a one bedroom i didn't want.......my lease ends in Nov for the two bedroom that's now unusable what should i do????

  2. Personally, I would not come at this as a legal question. I would just find another place, move out and pay no more rent at the damaged place. Especially since the lease has only a couple of months to run anyway. Under these circumstances, it would be extraordinaly unlikely that your landlord would pursue you for breach of the lease (if it even is a breach).

  3. You should let the know that you don't want a 1 bedroom apartment and if they can't put you back into a two bedroom you will move somewhere where they could accommodate what you need. It isn't a rocket scientist situation. They can't force you to sign the lease. That is the bottom line. Either they give you what you want or you move!

  4. If the complex maintenance was negligent in taking care of the complex. I don't understand why after the fire you would want to stay. Take the opportunity to get out of the lease on the two bedroom and find a safer place to live.
