Legal questions about visitation rights... when a convicted child molester is involved?

My babys daddy is a g*y man. He donated his sperm to me and my partner lydia so that we could start a family. after his daughter was born he decided he wants to be a daddy now. he was just convicted for statutory sadomy on a 5yr old boy (his nephew) BUT he was not sentenced to prison. He paid over $20,000 in lawyer costs and got off scott free with 5yrs probation. He took an S.I.S. plea bargain giving him no jail time. He wants supervised visitations, and wants his PARTNER to be able to accompany him. So they are saying babys dad, and his g*y partner... are ok to come get MY CHILD and leave with her. I DONT WANT MY CHILD ALONE WITH HER FATHER!!! EVER!!! what can I do to stop this from happening?

  1. If this is true then  his Lawyer and the Judge are just as guilty as he is, the advise I would give you would probably land you in jail instead. I believe your hunting for legal advise though. just wanted to express my opinion.  


  2. did he donate sperm through a clinic, and had you inseminated by a doctor?  did you have him sign a waiver of rights and responsibilities?  If you did, then this will all be a lot easier.

  3. Take him to court to prevent visitation, plead your case.  And if he does get visitation rights, insist it is only with court appointed supervision.  Usually with pedophile they are not allowed any contact with children except with supervision - like in this case.

    And why why why wasn't he convicted of rape?  Ugh.  It's hard to believe that even now we decline to prosecute to fullest extent.  First time offender or not, I am sure he has multiple instances of hurting other children.

  4. Take him to court. If he was convicted of child abuse the courts should have no reason to let him see your child.

  5. I would try and get a temporary restraining order on you, your partner, and child for reasons you fear for your child's safety. If he donated sperm i do not think that makes him the dad, i think that you and your partner should be the only ones in question. If you try i am sure you could get his case thrown out the window, but when you say you don't want him and his partner around your child, i think myself, that he could probably bring up your own personal life to the courts. That might not be a good enough reason to dismiss his wish for visitation, but the thing about child molestation should really do the trick...

  6. my cousins boyfriend was convicted of child molestation of his first child and is NOT ALLOWED to contact my cousin or the child that they have together.  He did have to serve 5 yrs.  

    I don't think that it matters if they served jail time or not.  I would contact a lawyer and see what they say about it.  Tell them the situation and see what your options are.

  7. Sounds like you will be visiting a lawyer yourself.  That would be the best thing to do to keep him away from her.  Make them pay an ungodly amount of child support if they see her.  And make them have supervised visition.  Good Luck.  I hope it all works out.

  8. I can't imagine the situation you are in, I would do anything to protect my child. If he is on probation part of his requirement is probably to stay away from children so you can fight this and win. Worse case scenario is that if he had to have supervised visitation it could be a neutral place that the court chooses. He would not be able to pick up your child without the court appointed monitor.

  10. He was a sperm doner. He will not win a case. Sperm or egg donors have really no rights to the child. Plus he is a rapist of a 5 year old.

    He will not be allowed to take your child, don't worry.
