Legally, how can you get a debtor to uphold their side of an agreement if disputing items on credit report?

So as to clean up your credit report and settle some of your debts?

If you are negotiating with a debtor how can you guarantee that they won't fail to uphold on their side of the agreement;

Example,

You owe ABC debt company $200 dollars, they offer to settle the debt for $100 dollars plus they will report to the 3 credit report agencies that the debt either never existed or that it was never late and paid in full ?They get the check for $100, and then half a year later you see that ABC debt company still reports the item as late , and they are calling saying you still have to pay $100 more dollars? You ask them why is this when there was an agreement? They say they don't know what your talking about?

So how can you legally avoid this? if they don't agree to what they promised, what kind of recourse do you have?

  2. If you have the agreement in writing, it would be a pretty simple breach of contract lawsuit.

  3. Simple. Get it in WRITING.

  4. You just send a copy of your agreement to the credit bureaus. They'll delete it.
