Lending money laws?? is my husbands money lost?

My husbands ex-girlfriend and mother of his child signed some papers when he lent her $5,000 that hes been paying with his credit cards, cuz she hasn't in a long time, she is broke and I think she filed for bankrupcy... if he goes to court would they force her to pay or put her in jail or something? cuz he says that if she has nothing they can't force her to pay... =/ how does that work?

  1. there is no debtor's prison but she could be held resposible for fraud if it is proven that she never intended to pay as in NO paymentsalso the debt can be registered against her taxes or any future bankruptcies, in which case your husband would realize court ordered payments of cents on the dollar.  Worth registering the debt, because it also impacts any goverment money she gets in some states eg food stamps,Medicaid.


  2. is he paying child support. the papers she signed? were they an agreement that she was going to pay the $5,000. He should not be using his credit card. if she filed bankruptcy section 13...then you won't get much if anything.

    Yeah he's probably screwed, but Gee Whiz! You guys need to pay attention to what you're doing. Loan money to someone with money problems? Gee Whiz!

  4. An inability to repay a loan is not a defense.
