They would surely look stupid taking a teenager to court for something on a Bebo profile wouldn't they? The point I'm trying to make is that I think that some of the copyright laws are just a bit extreme. So long as you don't attempt to sell things claiming to be the copyright owner or steal their logo for your own business you are not comminting one of the worst offences imaginable.

Instead of chasing people for stupid things like copying songs, shouldn't they be chasing real criminals like murderers and rapists?

Do you agree?

  1. 'if' this were to happen, the person would be stupid not to remove them when asked.

if it were taken to court, i think it would be the kid looking stupid trying to make a point when something is clearly illegal.

microsoft isn't the police, they can't chase rapist.  but they could chase 'this person' that is actually doing something against them

and if they file a legal complaint, then the police have to take action..

it's just the way it is.. so get used to it, sorry!

  2. trademarl law says that if they don't pursue each and every potential violation, they can lose all rights to the trademark itself.

so yeah, expect to hear from them on trademark grounds mor so then copyright grounds. you might be able to offer a fair use defense to copyright charges, but not trademark charges.

they won't contact DMCA request first with the web host, and they will take it down. see chillingeffects.org for how that works.

you may not like IP law, but you probably don't understand it either. the basis for it, and the actual reason for it, is in the constitution itself. if you have a problem with it, you can start a campaign to amend the constitution :)

  3. its very doubtful, but its possible.

McDonalds sued a british couple for millions for having out leaflets (showing the exact contend of mcdonalds food) outside one of their stores.

  4. Wow, you must be working on a project here or something :)

You may think they'd look stupid to take you to court over something like that but they wouldn't care.   They pour alot of money into logos like that and have and will contginue to force people to remove or cease to use them at the threat of legal action.

    It's all about the Benjamins.

  5. They don't know if you are copying songs for your own purposes or for commercial distribution.
