Question:

Levy towards collecting debt?

Hello,

I have some debt & I was making my payments on time with the collectors. Now today I get mail from superior court saying the collectors have made a levy against me even when I was making my payments on time. I'm confused at this moment so my question is Can they even do that?

Thanks for your time.

  1. Dang that sucks! I know from past experience and learned it can be done with the blink of an eye.  One day I had over $500 in my checking account and then when I did on line banking to check to see what had cleared, I had a penny to my name only! My account had been served a levy and it was wiped out and I had been making my payments also.  They could not take it all because they can't leave you completely broke so that justified the one cent balance.  You should definitely call the number given to you on your paper work so that it shows an attempt or "due diligence" was made on your part and hopefully you can be given an explanation so as that you understand fully what can be done to help your situation out before they start doing a garnishment also.  Our system really doesn't care as long as they receive what is owed to them.  Depending on your debt, doesn't matter how much you owe either, you can't even resolve it with bankruptcy.  Or years past either.  If its child support it might be the fact that a new system is being implemented and going nation wide, not just state.  Good luck, but definitely call the source if available.
