Question:

Liability in a Town Home

Recently water has started coming up through my kitchen floor through a crack. There are no appliances that require water in that area. I am in a townhome with 4 units. I think that this is the water pipe going to my neighbors unit. Who would be responsible for fixinig this. Myself, my neighbor, or the town home association. Anyone have any help on this?

I am assuming that the water is not coming from ground water or rain runoff.The first thing I would do is let everyone know that it is happening and that you suspect that a waterline has started to leak. USUALLY, each individual owner is responsible for the repair of anything that happens to their unit. Like a sewer blockage or damage from fire. The problem is finding which unit is causing the damage here. The water provider can check to see where the leak is by using companies that specialize in finding the leak. Call them and start the process. You may be responsible for the water, who knows? But if one of  your neighbors owns the leak then they will probably make a claim with their homeowners insurance. As you might start the process there also. If your insurance is found not to be responsible, they will go after the offending party. I also would get on this

    ASAP. The leak will only get worse and the damage will get greater in time. Sorry.
