Liability insurance, accident?

My car was hit from behind (not my fault), pretty badly, and I have only liability insurance. Looks that they may total it. A towing company took my car to a yard where they charge for storage. What should I do after I get the accident report? Where I have to do my claims? The car that hit me had full coverage insurance. Will they pay for the towing and storage of the car? Can i sell the car as junk before the other insurance company will do something?

  1. the other insurance will pay for the towing, storage, and repair, if its not your fault. but some insurance company move really slow with liability claims you might have to pay for the towing and storage yourself then the insurance company will refund you the money depending on the situation.


  2. the other guys insurance will pay the replacement value of your car plus towing and storage but they will own the car they will also pay for a rental car untill you get your check

You should contact the other person's insurance company.  Let them know where the vehicle is.  They may ask you for "permission to pull" the vehicle to their salvage yard if the vehicle is incurring storage charges.   If you do not grant them permission, they may ask you to move the vehicle to a place where it is not incurring storage, or they will simply let you know that they will not pay for storage after a certain date.  Just cooperate with them,  life will be much simpler for you.

    If the vehicle is totaled, they will offer you the Actual Cash Value.  Do not sell the vehicle to the junk yard until the other insurance company has the opportunity to inspect the vehicle. If you sell it, and they pay you, then they will deduct the salvage value from the settlement.   If you only have liability coverage, your insurance company is not going to inspect the vehicle.  

    The other party's insurance company will pay for all reasonable storage charges and the tow expenses.   They should also authorize rental while the settlement is pending.

  4. Well, I'd pay to have that car moved back to your house, TODAY.  The other party has NO obligation to pay your storage fees!!  OR towing!!

    "Full coverage" doesn't mean they're fully protected, and it ALSO doesn't mean that driver was covered.  

    If you sell your car for junk, the other insurance company isn't going to pay you.  If you want to get paid for a total loss, you'll need to sell your car to THEM, as part of the claim settlement.

    You're going to have to wait and see what the adjuster says - if they call you.  Otherwise, you'll have to sue the owner and the driver of the other vehicle, in court, for the actual cash value of your car.

  5. I would go to your insurance agent and let him handle it. That's part of what you pay them for.

    Your insurance agency will contact the other guy's insurance company and get your money or take them to court for you.

    Take a copy of the police report with you when you go to your agent it will speed things up. If you got the other guys information (name, drivers license, address, phone number, ect.)

    If they total your car it will be their car.  (unless you buy it back from them) so no, you cannot sell it before settlement

  7. Don't sell the vehicle. If you sell it, you no longer own it and therefore have nothing to claim.

    Get the police report and file a claim w/the other company immediately. They will explain the procedures that need to be followed.

    You also have the duty to mitigate your damages. Meaning securing your vehicle from further damage or accruing storage fees.  Call your carrier and ask them for a shop they use that you can move the car to so you aren't charged storage. Or if you can move your car to your home and store it in a driveway or garage, do that. The other insurance company may not cover excessive storage fees.

  8. first off, they are NOT going to pay you replacement cost on the car.  they are going to pay you ACTUAL CASH VALUE...HUGE difference.  the other persons company is who should be paying you that plus putting you in a rental until the claim is settled and they should also pay the towing and lot fee.  call his company and make sure he reported it and I hope you have a police report!  do NOT sell the car!!!
