Question:

Louisiana Probation Violation?

A friend of mine is in a pickle and I would like to give her some advice but I have no clue. I hope someone can help me. Her fiance' was just called by his probation officer and he stated that he was going to be arrested tomorrow for violation of his probation. The stated violation was that he had pictures of him drinking and pictures of him out of state. Both of those things are a violation. The only place she put those pics were on myspace. But her profile was set to private so she is unsure how they would have gotten them. So...I have three questions:

1. What kind of time is he looking at?

2. The pics are not datestamped so how can they prove if he was on probation at the time?

3. Can they use things off of her website even though they are not married? That seems like a violation of her privacy!

  1. The maximum amount of time he is looking at is the remaining part of the suspended sentence he received(as to how much time he will get it's pretty much up to the probation officer....... the DA and judge typically listen to what he recommends.) The pictures are public info and he could use these. As far as the PO proving the date of the pics, maybe he is just waiting to get your friend to admit he was drinking and out of state(often times law enforcement has nothing until they scare the h**l out offenders and they  talk themselves into jail.)


  2. The internet is not private therefore they broke no privacy laws.  People are fired from jobs daily for putting things about their employers on MySpace.  

    Stupid finace ... she was insane for posting the photos.  But he's the real idiot.  He violated probation -- what was he thinking?  

    NEVER EVER put anything anywhere on the internet if you want it kept private.  NEVER!!!!
