Today i had my first car accident, I'm only sixteen and just recentle got my license. I was in the McDonalds parking lot and i backed into the women behind me, going maybe 5mph. I drive a 2005 Toyota Corolla my car has no damage but, she was driving a 2003 Chevy Tahoe and her bumper was bashed in. She called police and was being totally anal about the whole situation. She wouldn't exchange information with me she was extremely rude, and the police took her side i guess because, it was my fault they talked to her for about 10 minutes and didn't ask me any questions at all. She told me that her neck hurt and she was "Fixin' to get payed" and before she drove off she yelled "F*ck you F@ggot." Can she seriously get some kind of settlement from this, theres no way she could have whip-lash. What should i do?

  1. When the cops were there, you should have brought up the fact that she wasn't exchanging information for you.

    Otherwise, like it or not, it was your responsibility to check behind you before backing up. Since she was already moving, she had the right of way, which is why the cops took her side.

    As far as her neck, she'd have to prove in court that she has an injury. If she actually does, then you're just out of luck.
