MY CAR GOT HIT IN A HOSPITAL'S PARKING LOT WHILE I WAS WORKING. WHAT SHOULD I DO?

IT WAS PARKED AND I SAW IT WHEN I CAME OUT. I TOLD THE HOSPITAL SECURITY AND THE SAID THEY WHERE GOING TO CHECK THE CAMERAS. CAN I SUE THE HOSPITAL FOR BAD SECURITY, BECAUSE THEY DIDNT SEE ANYTHING. OR WHAT CAN I DO

  1. Absolutely no chance of suing the hospital.  In their parking lot there WILL be a notice saying that you leave your car parked there at YOUR OWN RISK.  Do you expect your car to be covered by security wherever you choose to leave it? On the street?  It is only comparatively recently that this ridiculous fixation with suing people for events which are quite clearly accidents, or the fault of someone else has arisen.  If the driver who hit you cannot be traced, then you need to claim for the damage off your own insurance or repair it yourself to preserve you no claims.  End of.


  2. Usually, all public car parks have a sign up saying that cars are parked at their owners risk. Parking in a car park is no different to parking on a road. If you find your car is damaged, and you can trace who the other driver was, you claim off the other driver. If you can't trace the other driver, but you have comprehensive insurance, you can claim on your own insurance, but then it goes down as your fault as your insurer has had to pay out. If you don't have comprehensive insurance and you can't trace the driver, you have to pay out of your own pocket.

  4. You need to prove that the hospital was negligent.  This incident would have occurred with or without security.  How should they have known that another vehicle was going to accidently strike your vehicle?  What could they have done to avoid the incident?  

    If you have collision coverage, use it.  That is your only recourse.

You can not sue the hospital it was an "assumption of risk" when you parked your vehicle in their parking lot.  basically you will have to report a hit and run to your insurance company, if you have uninsured motorist coverage it may help with your deductible.  If they did catch the accident on the surviellence you may be able to get a license plate # and give this to your carrier to try and pursue the at fault party.  However like most companies they only release their videos if it is subpeoned or requested from the police directly (which the police probably will not do due to a minor accident like this)

  6. The Hospital is not responsible for damage done to cars in their parking lot. What you need to do is contact your insurance company. If you have the license plate number of the car that hit you,you need to report that to the police. If you can't get a plate number, the damage will most likely be taken care of by your "uninsured motorist" coverage.

    BTW, if you do not have "uninsured motorist" coverage, I strongly suggest you get it.

  9. Report it to hospital security, police and then your insurance.  Under no-fault coverage in Florida, your insurance will pay for the repairs, less the deductible and if the person who did the damage is located, you will get your deductible refunded.

    If your car gets hit at the grocery store - you can't sue them.

    If your car gets hit while parked in front of your house - you can't sue yourself.

    It does not matter whose parking lot you were in.

    Call your insurance agent. If you have collision coverage, that will pay for the damage to your car less your deductible. In some states (not all) this may fall under your uninsured motorist coverage if you have a police report.

    Your agent will be able to tell you if you have the right coverage and get the claim filed.

    The  person you could sue - is the person who was driving the car that hit you.  

  12. First thing you should do is fix your caps lock, it's broken and stuck on.

    No, you can't sue the hospital for bad security.  Well, actually you can, but you'd have very little chance of prevailing against them, they don't guarantee you a safe spot to park, only that they will patrol and have cameras watching.

    If the tape reveleals who hit you, and you can get a clear plate number, notify the police.

    If not, and you have collision coverage, it will be covered less your deductible amount, if any.

    In either case, do contact your insurance agent for advice.

  13. YOU CAN STOP TYPING IN ALL CAPS FOR STARTERS. There is no reason to sue the Hospital. They didn't hit your car. Just contact your insurance and have them deal with it.
