MY mom is Renting a CONDO in Vista CaLifornia . BUT she is GETTING Notices from the BANK Saying it is BEING FORECLosed.. now the LANDLORD isn't getting back to her.. She is Month to Month RIght now. Maybe her Landlord isn't Paying the mortgage and just keeping the rent. but what is the law and what should we do ? I heard there is a term for what the landlord maybe doing? its called. RENTAL SKIMMING .. can you tell me more? or what should my mom do ?

  1. I doubt there is anything that can be done in this situation. Because your mom is month-to-month, the agreement can be terminated by either party before the beginning of the following month (or 30 days max). There might be some outside, random chance at a civil action for fraud, but even that would be a long-shot--especially in California.    


  2. Until the foreclosure actually occurs, the landlord is still the legal owner of the property, and the tenant still needs to pay rent, if they are occupying.  What the landlord does with his money (pay his mortgage or not) has nothing to do with the tenant.

    Note, as a tenant, your mom may be listed on the foreclosure papers. Not that she is doing anything wrong, it's just that if the bank does foreclose, then they will have the right to evict her from the property.

  3. contact an attorny i know that much..

    you would need to know your rights in your state for tenants beings that your month to month id say you cant do a thing. maybe that is why the landlord has you month to month cuz they didnt plan to pay the bill
