  1. Definitely defective, although I've never heard of a MacBook with a battery release lever... the Macbook uses a small rotating disc-lock that can be turned with a quarter (or any coin) that retracts and extends a 2mm metal plate that locks the battery in place. (in fact even the previous models of iBook & Powerbook used a similar rotating battery locking mechanism) The MacBook Pro uses a pair of sliding metal locking tabs which are on the outside of the housing, so there's no way for any part of them to break off inside and cause problems.

Where did you buy this computer? I only ask because it almost sounds like someone sold you a counterfeit laptop. They're made in China & are garbage. Or if you bought it used it may be an old powerbook G3 that is masquerading as a MacBook. (they are the only Mac I can think of that has had a battery release 'lever')

    Here's a series of links:

powerbook G3 (this one has battery levers):

I may be wrong and you're just using an unusual term for the rotating  battery release cam, but I want to be thorough. If this is the case you should send it to Apple to be repaired.

  2. Defective - get it replaced.

I have been a Mac user for 8 years and never had an issue with any Mac I have worked with. It won't cost you anything to get it replaced.
