Making a left turn? Whos at fault?

A friend of mine was driving back to work after she stoped to make sure it was safe to turn she proceeds to turn but at the same time a kid on a motorcycle decides to accelerate his bike to like 100mph and hit the front end of her car....all the witness are saying that its the kids fault but some people are saying she turned in front of him...The kid was not on the road when she began to turn...he did not start running till about the same time she begins to turn

  1. Let the insurance companies and police handle it. Say nothing is the advice given. It sounds like the kid's fault and he's an IDIOT. He could have been killed. He should lose his license because he's too dumb and immature for the privilege if what she says is true. But then again, Darwinism, more than likely he will die in a motorcycle accident if he continues to drive like a jerk. You can never be too careful these days. I am very slow to pull out of my driveway because I know there are jerks that come speeding around the corner. I never know that might happen. So I will wait a little bit before pulling out. I don't want an accident.


  2. truth is she made a turn in front of someone...be a speeder or not and i guess it should /could have been both... the kid you say wasn't on the road then where was he.... sorry but Ive been riding bikes for 20 yrs or more these things happen every day... theres no reasons to why this happens people just dont see bikes..... it wouldnt have matter if it was a semi truck going 5 mph she still turned across

  3. It's good to have witnesses make statements in such situations. It's also a good idea to talk to a lawyer who might have some influence on and shed more light on this case. Usually the person making the left turn MUST yield to anyone coming straight through any intersection, or a pedestrian/cyclist, etc. and would be considered "at fault" if she/he hit anything.

  4. If the kid on the bike was indeed travelling at such a high rate of speed in an intersection, he was performing a criminal act (reckless operation) and is pretty much completely at fault. If this was indeed an 'intersection' with traffic signals, the max speed for that intersection was most likely 55 mph... any speed over 65/70 mph is most likely going to have all of the eyes of the law looking straight at the biker.

    Edit: The 'she turned in front of him' argument would at least be viable if he was moving at what could be considered a safe rate of speed. My opinion of 'squids' aside, if the motorcyclist didn't have the foresight to recognize that there was an intersection ahead and that cars can and do pull out into traffic more or less at random, he wasn't practicing safe motorcycle techniques.

  5. the previous answers make no sense. but from experience and proffession I say the kid's at fault because the first thing they are going to ask them both if they saw on another, Obiously your friend had already commited herself to the left turn therefore the kid on the bike saw her doing so therefore he  has to legaly slow down or stop, and wait till its safe to proceed. dont listen to the witnesses some will say this some will say that.

  6. Ticket the both of you, him for speeding and your friend for failure to yield to oncoming traffic the insurance will have fun with this one....
