I am a practicing management consultant in the Philippines, and I have recently been offered a stint in the States. I will not be a regular salaried employee, but I will stay there for about three or four months. I am not sure yet what documentations I may need, but I have a visit visa (B1/B2), can I use it?

  1. The B-1 classification would not be appropriate for an alien who wants to enter the U.S. to extend his professional services into the U.S.

A B-1 visa is appropriate for those coming to the U.S. as visitors for business. The function performed has to be a necessary incident to international commerce, and the efforts must result in the accrual of profit outside the U.S.

It sounds like your professional activities in the U.S. would go well beyond functions which can be described as necessary incidents to international commerce. Instead, it appears that you would seek admission to extend your professional practice to the U.S by performing personal services in the U.S.

  2. I believe you can.   Your visa includes official business, i.e., attending job-related seminars.  For as long as you won't be compensated - exclusive of per diem - while you are here in the States, then you should be okay.  Merry Christmas and good luck, Tammy!

  3. Absolutely not, unless your management consultant practice includes visa fraud.
